What’s wrong with migrating?

This is a response to Irfan Khawaja over at the Policy of Truth blog.

I am of Jewish descent. I am not a JewI was baptized a Catholic as a baby and have no plan to convert in the foreseeable future. I am nonetheless of Jewish descent. My paternal grandfather is a rabbi and my cousins from that side of the family are Jews.

My family patriarch migrated from Germany to Mexico during the turn of the 20th century. He migrated long before the Holocaust, but I wouldn’t be surprised if he was motivated to migrate to escape prosecution in Europe.

I also have slaves in my family tree. My great grand mother (Or was it great great? I forget.) was a black Cuban and my parents thought I might be born with dark skin. Blacks, for those who are keeping score at home, are not native to Cuba. Slavery in Cuba did not end till 1886. My great grandmother migrated to Mexico to escape prosecution in Cuba.

I myself migrated to the United States at the age of two. I might have been born in Mexico, but I was a libertario at birth. I loved Mexican food but that was not sufficient reason to stay in a country with such a poor conception of personal liberty. So I kissed my mother good bye, packed my bags, and crossed the border. I ended up settling down in Los Angeles, where I could have Mexican food and liberty.

What I am getting at here is that there is nothing wrong with migrating.

Had I stayed in Mexico I would likely be dead now. If a cartel member asked me to pay protection tax I would have refused and instead given him a speech on why we should legalize drugs. My town of birth, Morelia, is one of the capitals of the drug trade so you can imagine how long I would have lasted.

Had my great grandmother stayed in Cuba she would have to live with left over discrimination against slaves and their descendants. Worse still her descendants would be living in Castro’s Cuba!

My family patriarch might have survived the Holocaust if he had stayed in Europe. Or he might have been baked.

I agree with Irfan Khawaja that one should be assured of their personal safety and liberty regardless of any incidents of birth. I also agree with him that Benjamin Netanyahu, current Israeli Prime Minister, is wrong to urge European Jews to migrate to Israel. Israel is hardly a safer country for Jews than Europe.

Where I disagree is that I see nothing with migrating or urging others to migrate in pursuit of safety or liberty. There are times when one should hold strong and defend themselves. There are also times when one should realize that your neighbors are bigots and they won’t stop being bigots during your lifetime. If you can improve your quality of life by migrating, why not do so?

For any European Jews who might be reading this: forget about Israel and come to the United States! Specifically come over to my hometown, the San Fernando Valley.  The San Fernando Valley is a lovely community within Los Angeles. The original Karate Kid series, and countless other films, take place in the Valley. The film industry is actually located in the Valley, not Los Angeles itself. Best of all, the valley is filled with Jews. My undergraduate university, Cal State Northridge, has one of the largest concentration of Jews in America. Did I mention that there is plenty of Mexican food to go around?

I’ll be honest, there are some drawbacks to the valley. We are ruled over by the incompetent authorities in Los Angeles city hall and attempts to form our own city have been thwarted over the years. Real estate prices are also high. Despite this though I love the valley and welcome others to migrate there if their current home is undesirable.

Should the Italian PM support the Democrats?

I don’t care for the Israeli government. Don’t get me wrong – I don’t care for Palestine government either. I have a particular distaste for Israeli politics in my heart though.

Israel has some points to its favor; it is one of the few countries in the near east with a relatively liberal domestic policy towards its citizens. Its economic freedom is also relatively high. The country gets bonus points for its law of return which has granted an easy pathway to citizenship.

The country is far from perfect though. Its liberal domestic policy does not extend to its non-citizens. Defenders of Israels are correct to point out that Arabs are free to become citizens, but it cannot be overlooked that a considerable number of resident Arabs/Palestinians are non-citizens. Nor can it be overlooked that its military and religious institutions play a strong role in civic life.

Israel is by most accounts a ‘middle’ country. It has liberal market-based institutions, but it still has plenty of areas for reform. Non-citizens must be recognized to have the same human rights as citizens. Military conscription must be ended. The state must cut ties with religious figures and be truly secular.

One of my biggest concerns over Israel though is that it continually attempts to treat American Jews as de facto Israeli citizens. I was reminded of this while reading the Washington Post and seeing that one of its articles was about the Israeli prime minister favoring the Republican Party. The author seems to believe that the Israeli PM should support the Democrats, whom American Jews overwhelming support.

This is of course silly. Should the Italian PM support the Democrats? American Catholics are Democrats after all. The Italian PM however acts in the interests of his state, not Catholics. Roman Catholics may have a special connection to the Vatican and Italy, but this connection is religious not civic. Alternatively, does Saudi Arabia have any reason to support Muslims in American politics? Again no – the Saudi King is a temporal power not a religious one.

Israel contains several religious sites of importance to Jews, Christians, and Muslims but that’s it. The Israeli government has no mandate from heaven to rule over the world’s Jews. It is unclear as such why the interests of American Jews or the Israeli should be treated as interchangeable. American Jews may be Jews, but they are foremost Americans. Likewise American Catholics or American Muslims are Americans first.

The United States is a country that thrives on diversity and tolerance. One can be a Mormon, Muslim, or Atheist and still be an American. One can style themselves a “Russian-American” and still be an American. The United States however needs a unifying force for this system to work. Some believe that this unifying force should be a common language or religion, but I disagree.  Liberty, not the English language or Christianity, is what defines an American. 

I urge as such for American Jews to reject any temptation to consider themselves de facto Israeli citizens. American Jews owe no fealty to the Israeli government and it in turn owes American Jews no fealty. If one wishes to be an Israeli by all means migrate there. Similarly if there is anyone out there who wishes to become an American I more than welcome you to come. Open borders and all that jazz.

Federalizing the Social Sciences

A few days ago I asked whether the social sciences could benefit from being unified. The post was not meant to make an argument in favor or against unification, although I myself favor a form of unification. The post was merely me thinking out loud and asking for feedback from others. In this follow up post I argue that the social sciences are already in the process of unification and a better question is what type of unification type this will be.


What is a social science?

First though allow me to define my terms as commentator Irfan Khawaja suggested. By social sciences I mean those fields whose subjects are acting individuals. For the time being the social sciences deal with human beings, but I see no particular reason why artificial intelligence (e.g. robots in the mold of Isaac Asimov’s fiction) or other sentient beings (e.g. extraterrestrials) could not be studied under the social sciences.

The chief social sciences are:

Economics: The study of acting individuals in the marketplace.

Sociology: The study of acting individuals and the wider society they make up.

Anthropology: The study of the human race in particular.

Political Science: The study of acting individuals in political organizations.

There are of course other social sciences (e.g. Demography, Geography, Criminology) but I believe the above four are those with the strongest traditions and distinctive methodologies. Commentators are more than encouraged to propose their own listings.

In review the social sciences study acting individuals.  A social science (in the singular) is an intellectual tradition that has a differentiating methodology. Arguably the different social sciences are not sciences as much as they are different intellectual schools.


Why do I believe the social sciences will be unified? 

On paper the social sciences have boundaries among themselves.

In practice though the boundaries between the social sciences blurs quickly. Economists in particular are infamous for crossing the line that the term ‘economics imperialism‘ has been coined to refer to the application of economic theory to non-market subjects. This imperialism has arguably been successful with Economists winning the Nobel prize for applying their theory to sociology (Gary Becker), history (Douglass North, Robert Fogel), law (Ronald_Coase) and political science (James M. Buchanan). The social sciences are in the process of being unified via economic imperialism.

Imperialism is a surprisingly proper term to describe the phenomenon taking place. Economists are applying their tools to subjects outside the marketplace, but little exchange is occurring on the other end. As the “Superiority of Economists” discusses, the other social sciences are reading and citing economics journals but the economics profession itself is very insular. The other social sciences are being treated as imperial subjects who must be taught by Economists how to conduct research in their own domains.

To an extent this reflects the fact that the economics profession managed to build a rigorous methodology that can be exported abroad and, with minimal changes, be used in new applications. I think the world is richer in so far that public choice theory has been exported to political science or price theory introduced to sociology. The problem lays in that this exchange has been so unequal that the other social sciences are not taken seriously by Economists.

Sociologists, Political Scientists, and Anthropologists might have good ideas that economics could benefit from, but it is only through great difficulty that these ideas are even heard. It is harder still for these ideas to be adopted.


Towards Federalizing the Social Sciences

My answer to economic imperialism is to propose ‘federalizing’ the social sciences, that is to say to give the social sciences a common set of methodologies so that they can better communicate with one another as equals but still specialize in their respective domains.

In practice this would mean reforming undergraduate education so that social science students take at minimum principle courses in each other’s fields before taking upper division courses in their specializations. These classes would serve the dual purpose of providing a common language for communication and encouraging social interaction between the students. Hopefully social interaction with one another will cause students to respect the work of their peers and discourage any one field from creating a barrier around itself. A common language (in the sense of methodology) meanwhile should better allow students to read each other’s work without the barriers that jargon terminology and other technical tools create. It is awful when a debate devolves into a semantics fight.

Supplementary methodologies will no doubt be introduced in upper division and graduate study, reflecting the different needs that occur from specialization, but the common methodology learned early on should still form the basis.

The unification of the social science need not mean the elimination of specialization. I do however fear that unless some attempt is made in ‘federalizing’ the social sciences we will see economics swallow up its sister sciences through imperialism.

As always I more than encourage thoughts from others and am all too happy to defer to better constructed opinions.

Could the social sciences benefit from being synthesized?

This past month a paper Marion Fourcade, Etienne Ollion, and Yann Algan by on the ‘Superiority of Economists‘ has made the rounds around the webs. Our own Brandon has made note of it before. I have given the paper some thought and cannot help but wonder if the social sciences could not benefit from being synthesized into a unified discipline.

Some background: I have been studying economics for a little under half a decade now. By all means I’m a new-born chicken, but I have been around long enough to have grown a distaste for certain elements of the dismal science. In particular I am disturbed by the insular nature of economists; relatively few seem interested in dropping by the History or Political Science departments next door to see what they’re working on. I cannot help but feel this insular nature will be economic’s undoing.

It should be no surprise that I hope to enter CalTech’s Social Science program for my PhD studies. The university is famed for its interdisciplinary nature and its social science program is no different. Its students are steeped in a core composed of microeconomics, statistics, and the other social sciences. For a while the New School in New York City offered a similar program.

I am sure there would be those who would object to synthesizing the social sciences into a unified discipline. Sociology and Economics might be more easily combined (as they were by folks such as Gary Becker) than Economics and Anthropology.

I am eager to hear other’s thoughts on this. Is the gap between the social sciences too large for them to be unified? Is unification even desirable? Should we content ourselves with an annual holiday dinner where we make fun of our common enemy?

Libertarian as Ethnicity

The past few months have been busy, to say the least. The Obama administration announced a series of executive actions regarding immigration and that has taken up most of my time. Meanwhile in my day job as a graduate student I’ve been overwhelmed with midterms and finals; I am sure my fellows in NoL can sympathize with this. The few moments of peace I have enjoyed have gone towards pondering one question: Who is an American? 

The question is not isolated. By asking who an American is, I’m really asking what ethnicity, and other social groups, really are. The best answer to my question was an old Cato blog post appropriately titled, What is an American? In it Edward Hudgins discusses what makes an American. It is not, as some believe, a common language, creed, or ancestry. What makes an American is his love for liberty. It is in his closing remarks that Hudgins hits on something amazing, there is no meaningful thing as ‘American’.

Unfortunately, the American spirit has eroded. Our forebears would look with sadness at the servile and envious character of many of our citizens and policymakers. But the good news is that there are millions of Americans around the world, living in every country. Many of them will never make it here to the United States. But they are Americans, just as my grandpop was an American before he ever left Italy.

There exists those individuals who can prefix themselves as Americans, but at best this only tells us that they are somehow affiliated with the American continent. There exists a group of people who yearn for liberty and are willing to fight for it, but many of them were neither born or live in the United States. Likewise there are those who were born and live in the United States who are no friends of liberty. And so my initial question has lead me to a new one. Why not promote being a libertarian as an ethnicity? Why not introduce ourselves as ‘Libertarios’ instead of Americans, Germans, or Turks?

At first my proposal may sound strange to some. Would it not be silly to define an ethnicity by political views? I don’t think so. Few ethnic groups have a concrete basis in reality and are based more on fiction than anything else. I was born in Mexico, raised in the United States, and am directly descended from Germans, Jews, and Cubans. I feel little fraternity to these latter groups though. Why should I? I didn’t elect to have Jewish or Mexican ancestry, but I did elect to be a libertarian. Anyone who proclaims to be a libertarian automatically has my sympathy and support, even if I know nothing else about them. As this is the case I would prefer to be identified as a Libertario than any other ethnic group.

I am sure that there are those who would prefer not to be identified by any collective label at all. For those of you who fall into this category I would offer a pragmatic case for identify as Libertario.

I hope it can be taken for granted that, as libertarians, we wish there to be more libertarians. In the best scenario more libertarians in the world might lead to better public policy. In the worst scenario we at least have more potential friends. By promoting our existence as an ethnic group we would encourage more people to remain as libertarians. I have often found people who have libertarian political views, but who withdraw from participation if they become discouraged about the hope for change in their lifetimes. If we were an ethnic group though these individuals would continue to promote liberty, if only to signal their membership in the group. An ethnic group therefore not only encourages members to remain active, but produces positive externalities to promote the group’s message.

For comparison consider the Mormon people. Many Mormons spend time advocating on behalf on their religion, with several even going abroad on missionary work. From anecdotal experience I’ve noticed that many of them are ill treated when they perform their advocacy. Why do they bother to do so then? Because, as I’ve noted above, it signals their membership in the Mormon community. The average Mormon may not particularly enjoy being harassed for their beliefs, but they do it anyway to tell other Mormons a simple message, “I’m one of you.”

It goes without saying that there must be a benefit to belonging to a given group for this to work.

Additionally the existence of an ethnic libertario community would make raising children to be libertarians much easier. I side with Bryan Caplan in the belief that a relatively easy way to grow the movement is by simply having more children than the general population. It doesn’t matter if you believe children’s political beliefs, and by extension their ethics and other characteristics, are shaped by genetics or their nurturing, a libertario community would help with producing children. If you believe in the genetic argument, then an ethnic community reduces the cost of finding a spouse who shares your political beliefs. If you believe in the nurture argument, then surely a child raised among libertarians is more likely to end up being one himself.

Why not world government? Part 2

In Part 1 we gave a general definition to what world government, or ‘monopolis’ as I’ve suggested, was. Key to our definition was that a monopolis was neither inherently libertarian nor anti-libertarian. Some readers might scratch their heads and wonder if such a vague definition is of any helpful. After all if a standard dictionary were written in similar vague terms we would have entries that read like:

Broccoli: noun. A vegetable that can taste nasty except when it doesn’t.

Nonetheless I argue that my definition of monopolis is invaluable in that it clarifies that whether a world government is desirable or not depends on the details. This is an advancement over the extreme positions that world government, or any other ‘large’ government, is inherently bad or good in that it allows us to attempt to reach a middle ground. In other words the size of government has a bell-shaped curve relationship in terms of efficiency. Larger governments benefit from returns to scale, but there is a point where these returns to scale become decreasing or even negative. The ideal size of government is at the middle point – but it is unclear where exactly that middle point is.

What is the optimum level of federal government?

At heart I am an anarchist and would prefer a world composed of countless city-states that freely traded with one another. One would still be part of a government, but which government you were part of would be no more important than what baseball team you rooted for. If possible I’d do away with the city-states as well and allow individuals to contract with one another directly but alas we have not yet reached the conditions necessary for that!

Even in my anarchist utopia though there would be the need for a federal government that promoted inter-city trade. Without a strong federal government local states could easily erect trade barriers to protect themselves from outside competition. A federal government’s chief benefit would be in that it would act to reduce transaction costs between member-states.

At the same time there would be a cost to introducing a federal government in my anarchist utopia. A federal government strong enough to defy member-states can use the same power to give itself more duties. Indeed, the individuals who compose federal governments have strong personal incentives to grant themselves further powers. How else can the growth of the United States federal government be explained? At its inception the United States was little more than a trade and common defense pact – it didn’t even have the power to levy taxes and had to request funds from the constituent states. Compare that to today’s US federal government, whose tentacles can be found in almost every aspect of life.

Federal governments do nonetheless face internal and external constraints to what they can do. Federal governments have the ability to defy individual member-states, but they have less ability to confront several local elites at once. Take for example the Real ID act; passed in the early 2000s the Real ID act would have created a de facto national ID in the United States but it has thus far been stalled due to the opposition of several state governments. Externally federal governments are also constrained by competing federal governments. The United States federal government cannot devote itself entirely to dominating its constituent member-states, it must also pay attention to the actions of Russia, China, India, and other rival powers.

It is due to the latter reason that I do not favor world government; I fear that in the absence of competing federal powers the remaining federal government would be able to devote itself to centralizing power away from local elites.
I concede that there are two scenarios where my concerns would be lessened.

  1. In the first scenario the constituent member-states are strong enough that a small fraction of them can restrain the actions of the federal government. This would require a few member-states to be both significantly larger than the other constituent member-states and to have conflicting views on public policy than the federal government. A world federal government would need a ‘California’ or ‘Texas’ if you would.California and Texas could both become independent nations and safely be great powers. This position has allowed them to defy the federal government on several occasions as there is an implicit understanding that they could secure their independence if their long run interests differ sharply from the United States’ interests. Brandon Christensen has often pointed out the importance of allowing member-states to secede from their federations, and here I agree fully with him.

    The existence of a ‘California’ or ‘Texas’ is tricky though. Member-states will only stay in a federal government if they benefit from doing so and there are several scenarios where a member-state like ‘California’ might actually secede. Secession, done rightly, could induce the federal government to seek compromise or internal reform. Or it might attack ‘California’ and assert that secession is illegitimate. Peaceful secession, such as the break up of Czechoslovakia, is certainly possible but they are rare.

  2. The second scenario would be one where the federal government was constrained by its future self. Let us posit a monopolis, a world government, that was secure in its rule. Would the rulers of such a monopolis set tax rates at 100%? Not if they were concerned about future revenues. A monopolis would likely prefer to smooth its consumption over time and to do this it would have to find a tax rate that did not hinder future economic productivity of its citizenry too much. This scenario however would only arise if the ruling elite at the top of the monopolis governing structure were assured that they and their descendants would continue to be ruling elites for the foreseeable future. A monopolis would have to be a monarchy in essence.

In summary, a monopolis would be desirable if the details were properly adjusted to avoid reaching decreasing or negative returns to scale in efficiency. A monopolis would have to face constraints of some sort, which in the absence of external competitors would have to be either strong member-states that could achieve independence if desired and/or a ruling elite that was strong enough that it had no serious concerns about being overthrown. If these conditions could be met then a monopolis would be well worth it.

I for one am skeptical about our ability to achieve these prerequisites, but the argument is no longer a theoretical one. The question of whether a world government is desirable has become an empirical question as we need to find some way of measuring the likelihood of achieving the above mentioned perquisites.

Why not world government? Part 1

Since I joined the Notes On Liberty symposium Brandon Christensen and I have had a series of playful back and forth on the issue of world government. I initially intended to offer a comprehensive response on why I disagreed with Christensen, but after reading through older posts and comments I’ve decided that it would be best to clarify what we mean when we mean by world government. The point of this back and forth is not to have a ‘winner’ after all, but to better understand one another’s concerns and hopefully come to agreement after hashing out the details.

By world government I am referring to a polity that has jurisdiction over the practically inhabited universe. If humanity inhabited Mars, the Moon, Earth, and a few asteroids then a government that had jurisdiction over only Mars would not be a ‘world government’ despite it clearly controlling the governance of a planet. Conversely a monopolis needn’t cover a whole planet; the Roman and Chinese empires were both near-monopolis that controlled much of the practically inhabited world at their respective times. I understand that this might be confusing so I propose the term monopolis, “single city”, to refer to this concept.

A monopolis does not necessarily have to be ruled in a given manner. A monopolis could be an intergalactic feudal monarchy, such as the government of the Padishah Emperor and the Landsraad in the Dune series. Or it can be ruled as a decentralized federation of planets such as the Foundation in its title series. For our purposes we are dealing largely with a federal-monopolis, where several smaller polities exist as part of the larger federation that assures a minimum degree of individual rights are enjoyed by all federal citizens and that a reasonably free movement in goods (and people!) exists.

Is world government anti-libertarian? As a libertarian my knee jerk reaction is to view any government with deep suspicion, with an appropriately larger knee jerk as the government in discussion is larger. That is to say that I distrust the United States federal government more than I distrust the city government of my beloved Los Angeles. Christensen has written on this habit of libertarians to fall into this habit before. I agree with Christensen fully that his knee jerk reaction can be troublesome when it leads libertarians to reject large government policies as a matter of principle without further inspection on the details.

For example the North American Free Trade Agreement (NAFTA), the World Trade Organization, the Trans-Pacific Partnership, and others are ‘large’ government policies that I think all libertarians should support because they promote greater trade liberalization. By no means are any of these agreements about genuine free trade, and they contain several trade restrictions, but overall they have led to a reduction in trade barriers across the world.

I disagree with Christensen, or at least disagree in a matter of degree, in that I don’t think this knee jerk reaction is unwarranted. Individuals have less control over government affairs over as the government unit grows in size. I can go find my local councilman and harass him about my city’s poor budget with relative ease, but doing the same with my federal House of Representative is almost impossible. This lack of accountability to their constituents sets up incentives for public officials to indulge their private preferences. On occasion the private preferences of public officials align with the interests of constituents, hence the existence of things like NAFTA. However the latter is an exception, not a rule, in large governments.

In summary; most libertarians view monopolis as being inherently anti-libertarian. I do not believe that monopolis are inherently anti-libertarian and concede that a monopolis could in theory adopt libertarian public policy under specific institutional arrangements that aligned the interests of public officials and their constituents. I am however skeptical about how likely it is that this can be achieved. Christensen is apparently more optimistic on the matter than I.

A monopolis does not necessarily have to allow constituent members to leave freely. A monopolis could very well have arisen as a product of conquest. For our purposes though we assume that the monopolis allows constituent members to leave freely through some sort of referendum process. Christensen has discussed this in his latest post on the issue.

A monopolis has an over-arching form of ‘citizenship’ that guarantees its individual citizens a minimum of liberties. As I discussed in my last post, I prefer local citizenship, but I am willing to imagine a monopolis where an individual has a federal citizenship in addition to sub-level citizenships.

A monopolis in short:

  • Is a government that has jurisdiction over the practically inhabited universe,
  • Not necessarily organized in any specific manner, but for our purposes we assume a loose federation,
  • Not necessarily anti-libertarian in its public policies (but not necessarily libertarian either!),
  • Not necessarily the product of conquest, but not neither is it necessarily the product of members voluntarily joining,
  • And offers a form of federal citizenship that guarantees a minimum degree of liberties.

I ask that Christensen responds on whether he is willing to accept this definition of a monopolis, or world government, or offer his counter-proposal for a definition before we continue further.

Local Citizenship

In his latest blog over in Openborders.info, my usual stamping grounds, Nathan Smith discusses the need for citizenship to be voluntary. I agree with Nathan Smith wholeheartedly here. What value is citizenship if a man is forced to have it? A fellow citizen is someone you should be willing to share a meal with during the bests of time. A fellow citizen is someone you should be willing to trust in the trenches during times of war. A meal is never pleasant when your company is forced to be there, and I for one wouldn’t want to fight alongside an unwilling ally.

If citizenship is to be voluntary however the offer of citizenship should also be voluntary.  That is to say that a polity should be able to decide who it wishes to offer citizenship to. United States immigration law currently adds new citizens without much consultation to current citizens on whether they wish to accept newcomers. This is a plain violation of the right to free association.

It is for this reason that I disagree on granting US citizenship to its current illegal alien population. It is true that on occasion a majority of the US public favors granting a pathway to citizenship to the illegal alien population, but even during the best of times a substantial portion are opposed to it. I cannot see a justification to force someone to associate with another in political union when alternatives exist. To be fair, I also oppose granting citizenship to newborn babies regardless of whether their parents are recent Pakistani migrants or from Nebraska.

I favor instead replacing national citizenship in the United States with local citizenship. Cities are small enough that disgruntled minorities can easily move to somewhere more favorable to their views. City formation is also fluid enough that they can be broken up much more easily than their larger counterparts.

By no means is my proposal to radically change citizenship. The concept of citizenship was born in the Greek polis, and carried into the modern era through the Italian city-states and, to a lesser extent, the Swiss cantons and the Hanseatic League cities. Movement towards local citizenship would be the return to tradition, not a departure from it.

It was only after the French Revolution that we saw the rise of national citizenship as an idea in the western world. Arguably in the United States local citizenship was important up till the passage of the 14th amendment, which allowed the federal government to effectively nationalize citizenship.

We can already see early signs of local citizenship regaining popularity. In my home city of Los Angeles local citizenship is offered to residents who can prove they have a ‘stake’ in the future of the city. Stakeholder status is independent of migrant status and allows one to both vote and run in local elections. Stakeholder status can be achieved by showing that one lives, works, or owns property in Los Angeles.

Article 9, Section 906 of the Los Angeles City Charter readers:

“(2) neighborhood council membership will be open to everyone who lives, works or owns property in the area (stakeholders);”

In New York State there is a proposed bill, ‘The New York is Home Act’, that would grant New York state citizenship to those who have paid state taxes, have no substantial criminal record, and lived in the state for a certain number of years. This proposal is independent of one’s federal migration status.

The European Union also offers a model on how local citizenship can exist in union with federal citizenship. I favor this model the least as the EU regulates the obligations of member states towards federal citizens so heavily that the difference between local citizenships are becoming increasingly marginal. I fear that the ultimate outcome will be that, as in the United States, federal citizenship in Europe will simply become national citizenship.

My ideal world is composed of three pillars (1) local citizenship, (2) open borders, and (3) a common market. Cities could elect who they wish to grant the privilege of being involved in political life, and individuals themselves would be free to decide which city, if any, they would wish to join. There would still be those who felt they were being forced to politically associate but, an open borders regime coupled with fluid city formation and a common market, should allow this number to be minimized.


In his latest blog post on world government Brandon Christensen implicitly discusses world citizenship. I have previously aired my disagreement with Christensen on the issue of world government, but feel obliged to point out that the matter of citizenship is also one of the areas that leave me skeptical of world government. Namely my concerns are that:

(1) World citizenship would force all of humanity to associate politically, even if we rather not.

(2) World citizenship would create free rider problems among political actors. Why should one forgo the costs of becoming informed on political issues if their marginal effect on world issues is close to nill? Meanwhile larger governments, even if initially federal in nature, have a nasty tendency to increasingly take over local affairs. We need only look at the progression of transportation and education in the United States from being local affairs to federal ones.

On my to do list is to explore what the optimal amount of citizens is and a more detailed response to Christensen on the issue of world government. On the off chance that I should die before I can write the latter response, let me state for the record that I am actually quite supportive of international agreements such as NAFTA that bring us closer to a common market. I am even in favor of formalizing the loose federation that composes the western world. Where I stray is that I prefer an international order where powers like the Chinese and Russian spheres are strong enough to compete with the west.

On Conspiracies and Immigration Reform

Late last month I asked a simple question, what does the Obama administration hope to accomplish in regards to immigration? I answered that its goal was not to reform the United States immigration system unilaterally, but to use executive action to force Congress into acting.

My prediction turned out to be correct. The administration had initially planned to announce executive actions meant to provide relief from deportation for many of the country’s illegal alien population and to make legal migration easier after the Labor Day weekend. ‘Had’ is the key word here. In its latest series of press conferences the administration has pushed back the announcement till year’s end.

Why did the administration push back its announcement? Partly because the administration doesn’t really want to issue executive actions – it merely wants to use the threat of executive action. Some opponents of the current administration, including libertarians, envision the executive branch as having unlimited powers but the truth is that the administration has all too real limits to its powers. Members of the President’s own party lobbied for the postponement in fear that a radical change in immigration policy will cause them to lose their upcoming elections.

The state is not a monolithic beast with a single mind. Rather it is composed of several competing factions who are nonetheless united in their shared goal of maintaining a functioning order. The state is usually seen as the antithesis of the market, but I think this a wrong way to think. The state is itself a product of spontaneous order and better thought of as an example of how human cooperation can do great harm.

What this means is that the Obama administration must first secure its hold over its own party before it can duke it with other factions within the state apparatus.

It also means that conspiracy theories, of the like discussed in the comments section of my last post, are unlikely. It is true that ‘open borders’ could be used to rob the United States of its sovereignty in favor of creating a larger transnational state in its favor. However it is unclear why Obama and his allies, as individuals, should wish to see the creation of a new state unless they were assured they would be leaders in it. The creation of a new state is no small feat and usually requires a long time horizon.

Monarchs of the past could afford to undergo the long process because they were assured that even if they themselves did not live to see their creations their children would. Obama has no such assurance; in a few years he will vacate the White House and go into retirement. As a matter of tradition Obama, as most US Presidents have, will leave electoral politics. He may lend his support to some charitable cause, but he will never again be active in day to day politics. His incentives are as such to maintain the United States as strong as possible to preserve his legacy.

Who then does have the incentive to see the creation of a new state? Presumably it would have to be a faction in the current state apparatus that has some power but has been relegated to a position where they cannot expect to rise any further. In times of old this would be a Duke who, although strong, could not expect to see himself made King under the current regime because of one reason or another.

Which faction could fit the bill today? The Democrats? No. As noted above, current Democrats would not be assured of their involvement in a new state and would not risk their current power given their short time horizon. The Republicans? No. The Republican Party is believed by many to be destined to become a permanent minority party at the national level, but for the foreseeable future it still has enough sway to win a healthy amount of seats in Congress and could very well win the Presidency under a charismatic candidate. Even if the Republican Party is destined to become a minority party, why would it want a stronger state replace the US? It anything it should want the south and western mountain states to secede so that it could continue to influence national politics, albeit in a new nation. What about Hawaii? The far flung state owes its political union with the US to an overthrow of its indigenous monarchy. It may harbor some desire to regain its independence, but it is unclear why it would want to see the US by a larger state still. If anything the rebellious factions in the US should desire to break up, not increase, the current state.

By no means should I be seen as saying that conspiracies cannot be in play. I simply do not see the necessary incentives for a conspiracy to arise that would wish to see the United States replaced by a transnational state.

Let us compare this with the European Union, a new state in the process of being formed from the remnants of the previously separate European countries. As many observers have noted previously, it is hard not to notice that the European Union is effectively a new German Reich. Germany was unable to secure an empire on the continent using arms, but it has been immensely successful in winning its empire through commerce. German politicians and their bureaucrat allies have a clear incentive to see the continued rise of the EU, but even here there are rival factions who oppose them. One wonders if euroskepticism in the United Kingdom is truly because the British people oppose the EU or because Germany and its allies, and not the UK, will be the center of power in the new state?

What does the Obama administration hope to accomplish?

It is widely believed that the Obama administration will extend deferred action to include a significant portion of the United States illegal alien population following Labor Day. Some analysts are estimating that as many as five million illegal aliens will be provided some form of amnesty. I am skeptical this is the case, and believe it is more likely we will see smaller actions taken. The executive branch has a high degree of freedom when it comes to applying immigration law, but there are limits. The President’s actions thus far have been made with the goal of getting Congress to pass immigration reform, and any future actions are likely to follow that trend.

Let us consider for example the announcement of Deferred Action for Childhood Arrivals (DACA). DACA has provided temporary relief for half a million migrants in the form of work permits and legal presence. Perhaps more importantly it also strengthened a constituency that has a strong stake in seeing immigration reform passed by Congress. A cynic is tempted to say that the ultimate purpose of DACA was to create several thousand lobbyists.

Earlier this year the Obama administration also mused with the idea of extending the Military Accessions Vital to the National Interest (MAVNI) program to include those who had received DACA relief. The MAVNI program allows those who enter it an opportunity to earn US citizenship by serving in vital military roles. The actual perquisites to join the MAVNI program are high and it is doubtful more than a handful of DACA recipients will ever earn citizenship in this manner. As it is clear that this program is of little practical use, why did the administration bother with it at all? I suspect it was because it was hoping to win over support for immigration reform from military constituencies.

The administration has also proposed allowing spouses of certain legal migrants to acquire work authorization. Here too the idea is better in principle than actual practice, as only spouses of H-1B visa holders already in the process of gaining permanent residency are eligible. It is clear that the purpose of this proposal had more to do with gaining support among skilled migrants and their employers than it was about actually providing relief.

Opponents of increased immigration may consider the above actions to be instances of executive abuse, but they are all minor compared to what the Obama administration could do.

The Obama administration could, for example, lower the threshold necessary for a waiver of inadmissibility to be approved. A significant portion of the illegal alien population would be eligible to readjust their legal status either through their family connections to US citizens or by employer sponsorship, but they are barred from doing so because they have accrued unlawful presence. A waiver of inadmissibility is an existing process that pardons said unlawful presence, and it may suffice for the Obama administration to instruct US Citizenship and Immigration Services (USCIS) to be more generous when it decides whether to grant the waiver. Allowing illegal aliens to attain permanent residency and citizenship via this method would be a significant departure from past executive actions by providing long term relief.

The Obama administration has previously altered how the waiver of inadmissibility is granted by allowing it to be filed inside the United States instead of requiring applicants to do so in a consulate abroad. I am therefore skeptical that the administration is not aware of how relatively easy it would be to use the existing system to grant massive relief to the illegal alien population.

Furthermore I doubt the administration wishes to grant deferred action for a large portion of the illegal alien population as it may then find a decreased willingness to include a pathway to citizenship as a perquisite for immigration reform. Prior to DACA’s announcement there was broad support for passing a version of the Dream Act, but said support was lost as many saw DACA as being a de facto Dream Act. Few people know or care about the marginal differences between the two and many have perceived DACA as being sufficient. A large expansion of deferred action for the illegal alien population may, in the short term, provide them relief at the expense of making others perceive that there is no need for further action to help them. It may also lead to the current pro-immigration reform coalition to break apart and make it more difficult to increase the number of legal immigrants.

Liberalization of immigration law paradoxically makes it more difficult to find support for fully open borders. How much support would there be for open borders if all one had to do to legally enter a given country was sing the national anthem and pay for a ten dollar entrance visa? I suspect under such loose regulations the desire for open borders would be restricted to a handful of individuals interested in it on philosophical grounds.

The Obama administration cannot create any new pathways to citizenship for the United States’ illegal alien population. Nor can it create new pathways for legal immigration. It can however provide relief for the illegal alien population and ease the process for legal immigration. I doubt it will though, as its goal is to get Congress to pass comprehensive immigration reform with as few as possible executive orders.
