From the Comments: Military intervention, democracy, and stability

Longtime reader (and excellent blogger in his own right) Tam has an interesting response to Chhay Lin’s thoughts on the Paris terrorist attacks:

It is an interesting read indeed but there are two or even more sides to every story. What we are also noting is that many of these groups that hate Western interventionist policies also hate their own people for being different in one way or the other. However, I agree that the misplaced perception of democracy as the superior form of governance overlooks the essential internal historical and socio-political factors behind the politics of the different countries that have become victims of Western ‘sanctification’ processes fronted by bombs after daring to opt not to embrace democracy. Libya and Iraq were stable before Western intervention.

Tam’s point strikes at the heart of the difference between military interventionists and non-interventionists, I think. Libya and Iraq were indeed stable, but not everybody was free. In Iraq, Shias, Kurds, liberals, and religious Sunnis were all brutally suppressed, and this oppression stood in stark contrast to the freedoms that secularists, women, union members, some socialists, and the politically apathetic enjoyed. The sociopolitical dynamics in Libya were the same, though with different local actors.

This reality is something that both sides of the interventionist debate recognize, though the interventionist side seems to place much more faith in government when it comes to “doing something.” Jacques and Edwin, for example, have both argued that bombing ambiguous factions in Iraq, Syria, and Libya would contribute to the freedoms of the oppressed factions in those countries. Looking back on the debate makes it clear that they weren’t wrong, but look at what those freedoms have produced. Those freedoms have come at the expense of the freedoms of the factions that the dictators were protecting.

What this situation shows me is that the states of the post-colonial world are unviable. Stability comes at too steep a price (dictatorship), and democracy’s unpredictability only leads to predictably violent results in the post-colonial world.

This impasse, which I cannot be the only one in the world who recognizes, has led me to take a hard glance at two specific peace processes in the Western world: The diplomatic efforts of Europeans after the Napoleonic Wars (“Concert of Europe”) and the founding of the American republic, which is, in my mind, the most successful endeavor in the history of international relations. Neither of these efforts led to the complete abolition of war, but both have helped to maintain a relatively peaceful co-existence between large numbers of factions for long periods of time.

The Concert of Europe bought time for factions in the region to solidify their legitimacy at home, culminating in both the creation of Germany and Italy in the late nineteenth century and the infamous overseas imperial  domains of France, the UK, and the Netherlands (among a few others). While this peace process brought about prosperity for Western Europe, it was not inclusive and it still adhered to the Westphalian notion of state sovereignty. What state sovereignty means is that each state, in the context of international affairs, has a right to do whatever it pleases within the confines of its own borders (such as massacre hundreds of thousands of people in the name of stability). The Concert of Europe was also the precursor to the post-1945 peace process that created the state system that we all live with today, though I would argue that there are some elements that could be republican, such as the IMF and World Bank, provided some changes in mindset.

Aside from the problems produced by the notion of state sovereignty, the states of the post-colonial world today suffer from an issue of legitimacy, both from domestic populations and from foreign ones. Domestically, all of the factions that stability-inducing dictatorships oppress do not buy in to the argument that the states purporting to govern them are legitimate. In foreign affairs, many factions do not believe that these post-colonial states are legitimate either. Hence the calls for bombing campaigns, proxy wars, or outright invasions and occupations of states like Iraq and Libya by states like the US or France (even if these invasions come at the expense of domestic and international rule of law).

This situation, where post-colonial states claim to have sovereignty within an international state system but where domestic and international factions ignore such claims, is where we’re at today. It’s the status quo, and while it worked relatively well in a small part of the world for about hundred years or so, it’s obviously failing today.

Enter the founding of the American republic. Unlike the Concert of Europe, self-determination à la breaking away from the UK was a guiding principle of the federal system, rather than state sovereignty. Like the Concert of Europe, the statesmen who crafted the American republic were concerned about invasion, hegemony, and all of the other bad stuff that happens in the international arena. So they set up an inclusive, republican system of states rather than attempt to balance power off on each other, like they did in Europe. The republican, or federal, system tied each state up into the affairs of the other states, whereas the balance of power system contributed to the formation of rival blocs within the system. This is why Europe switched from trying to maintain yet another balancing act to building an actual confederation (though one that is far too complex than it has to be) after World War II.

From a strictly war and peace view, the republican state system has led to one war so far (dating from 1789). From the end of the Napoleonic Wars, in 1815, to today, the balance of power state system has led to numerous wars.

Now, I know what you’re thinking: Woodrow Wilson’s foreign policy was based on self-determination, and his foreign policy was a disaster. This is true, though I would argue that Wilson was simply confused about what self-determination actually implied. For Wilson, recognizing the self-determination of various groups within empires would lead to state sovereignty for these groups, and that this state sovereignty would then be protected by the institutions trying to maintain a balance of power. Wilson never entertained the notion of republicanism when it came to recognizing the self-determination of peoples living in empires, he simply thought empires were undemocratic. Thus, he was actually a proponent of state sovereignty rather than self-determination.

What I am not arguing for here is a Concert of Europe-type effort for Middle Eastern actors. I think it would be a disaster, largely because regional efforts at peace-building (rather than, say, trade agreements) are useless in today’s globalized world. The Middle East needs the West, and vice-versa. Peace will only be achieved if self-determination is embraced (by not only large swathes of Mideast factions, but Western ones as well) and the new polities can be incorporated into existing republican-esque institutions. This way, more factions have a voice, and bad actors can be more easily isolated. I am not necessarily arguing that the US or EU should welcome burgeoning Mideast states into their federations, but policymakers and statesmen from these countries should at least start thinking about how to encourage and embrace the notion of a Middle East that looks a lot like our own republican world and less like the one we gave them following the destruction of the Ottoman Empire.

Stability is overrated, especially if the notion of creative destruction is taken into account.

Myths of Sovereignty and British Isolation XV, From Dutch Model to German Kings

Continuing from the last post, the story of the temporary Anglo-Dutch fusion and then moving onto the German kings of Britain.The invasion of late October was not strongly resisted, James fled London and then England, giving Parliament the pretext to declare that James had abdicated. His son was ignored with the falsehood pretext that he was not the son of James and his wife, but a baby smuggled into the royal chambers. All this evasion and pretence should not be allowed, in Burkean fashion, to conceal the reality that Parliament had asserted itself as the sovereign power in the country, and accordingly that the monarch reigned at its pleasure, which could be withdrawn. This was not a restoration but a very radical innovation.

On the conservative side, it was designed to maintain a religious settlement in which only members of the state church were full citizens, removing rights James had given to Catholics and also Protestant Dissenters. The immediate impact then was a major loss of religious freedom, though partly based on fear that ‘tolerance’ was a tactic only for James on the road to state enforcement of Catholicism. We will never know the truth of that.

William’s Dutch invasion did not inspire much of a war as James II’ authority collapsed quickly, but further violence was to come in Ireland until 1691 featuring sieges and major battles, with the French helping the Catholic Irish against the Dutch prince turned English monarch. There was war in Scotland until 1692, featuring one of the infamous events of Scottish history, the Glencoe Massacres of Scottish Jacobites (supporters of James). The massacre was partly the result of clan rivalry, but was certainly also the consequence of state policies.

The Dutch connection disappeared with William’s death, as he had no children and the throne passed to Mary’s sister Anne, ignoring of course the claims of ‘James III’, the exiled son of James II. However, the impact of the Dutch connection was not just in the person of William. His reign as William III (1688 to 1702) coincides with the foundation of the Bank of England in 1694, which took place in the context of Dutch investments in London and a strong Dutch influence as a model of Protestantism, science, crafts, public finances, naval and merchant fleets, trade and colonialism which preceded 1688, including the exile of the liberal political philosopher John Locke in the Netherlands from 1683 to 1688, and was intensified by the Dutch invasion/Glorious Revolution.

The Dutch Republic had shown how to fight wars through a reliable, credible form of public debt which Britain was able to use in eighteenth century wars. Generally, the temporary relationship between the two states, which was somewhere between mere alliance and full fusion, was important in enabling Britain to become the leading eighteenth century power in Europe for all the things associated with the Dutch Republic in the seventeenth century.

The temporary semi-fusion of course had a drastic impact on British foreign and defence policy, which was now heavily oriented towards Dutch aims in northwestern Europe, and even the whole of Europe. Britain was heavily engaged in European politics, including wars, particularly the War of Spanish Succession (1701 to 1714), which led to Britain’s still current acquisition of Gibraltar on the southern tip of Spain and included one of the most famous victories of British military history, Blenheim, under on the most famous British generals, John Churchill (ancestor of Winston Churchill), Duke of Marlborough on German territory. The main aim of British participation was to prevent French domination of Europe, which was threatened by a French claim to the Spanish throne, and the possibility of over generous compensation to France if it gave up Spain, with regard to Spanish colonies and the parts of Italy dominated by Spain.

Moving back briefly to the period before James II, his brother Charles II, had a secret treaty with Louis XIV of France which meant that state policy was covertly guided by the French who were subsiding Charles. So the temporary semi-fusion with the Dutch Republic was itself nothing new in terms of British state policy coming under the influence of a European power, it was simply a more open form of it. Looking forward, William was succeed by Mary’s sister Anne.

Parliament then legislated for a Protestant only succession, which went to the Elector Prince of Brunswick-Lüneburg, generally known as the Elector of Hanover. This family supplied British monarchs from 1714 to 1837. The legislation of Queen Anne’s time precluded military commitments to Hanover, but inevitably in practice the defence of Hanover and the protection of Hanover’s interests in Germany were a major consideration of state during that period. The first two Hanoverian monarchs were more German than English, though the third of the Hanoverian Georges, George III established himself as a largely popular archetype of supposed British character.

Myths of Sovereignty and British Isolation XIV, Revolution and the Dutch Model in the Late 17th Century

The last post in this series looked at the impact of Dutch republicanism on constitutional innovation and revolution in mid-seventeenth century Britain. Now on to Dutch influence on the Glorious Revolution of 1688.

Britain, or what was still three kingdoms (England, Scotland and Ireland) only unified in the person of the monarch did not have just one revolution connected with the Dutch model in the seventeenth century, but two. Furthermore the second of those revolutions required invasion by a Dutch prince to happen. The Glorious Revolution, as that second revolution is known, established something like the modern British political system in 1688 in establishing that the monarch could not legislate or even nullify legislation without parliament, could not govern without parliamentary consent and that parliament had the right to decide who could inherit the monarchy.

That this fundamental reorientation of the state system took place through violence and foreign intervention is not the sort of thing that sovereigntist believers in a British special path separate from mainland Europe, since Edmund Burke like to emphasise. Edmund Burke, a remarkable parliamentarian and writer on various topics including philosophical aesthetics, of the latter half of the eighteenth century, is introduced here, because his way of presenting British history is very connected with his assertions of British superiority in Reflections on the French Revolution, his most widely read book.

Of course there were things to condemn in the French Revolution, and Burke was a very acute observer of the violent polarising tendencies within it before they reached their extreme points, but his assumptions about British history are absurd. Given the importance of the Glorious Revolution for the British polity within which he played a distinguished role (though never in government), and his wish to condemn revolution, he reacts by denying a real revolution in 1688, presenting it as essentially restorative rather than innovative and as an essentially peaceful consensual event. It was of course presented in that way at the time, but then the French Revolution was influenced by ideas of restoration.

Evaluating Burke’s attitude will require going back to those events. Inevitably there are debates about the real causes of the Glorious Revolution, but it is anyway undeniable that it was a reaction against the rule of James II, who had only come to the throne three years previously suggesting remarkably poor powers of persuasion and conciliation.

The collapse of his reign was in some important part the result of religious issues going back to the simple fact that he was a Catholic monarch in a Protestant country. This would have been tolerable for Parliament and everyone else participating in political life if James had left the state religious settlement alone and if he was to die without a Catholic heir.

James was, however, very busy with changing the state religious settlement letting Catholics into powerful positions, and more seriously institutionalising the Catholic church in ways that suggested that at the very least he intended to give it equal status with the Protestant Church of England. This could be defended on grounds of religious tolerance at the time and still is.

Unfortunately for him James was not successful at persuading many Protestants, even those subject to discrimination themselves, that he had good intentions, and his methods of enforcing changes in the state religious settlement did not suggest someone willing to limit his general powers as Parliament expected. These methods included the assertion of a Dispensing Power, in which laws were suspended at will, and measures to manipulate parliamentary elections.

At the beginning of the reign he benefited from an extravagantly royalist Tory Parliament, but in a short period became mistrusted and feared. The birth of a son in June 1688 brought opposition to a new peak as it suggested that what James II had done would last beyond his own lifetime and it was not enough for those who disliked his policies to simply wait for his death, which would bring his Protestant daughter Mary to the throne, if he had no male heirs and she lived long enough. The outcome was that the Immortal Seven, seven prominent parliamentarians invited Princess Mary’s husband, Prince William of Orange to invade England.

The title ‘Orange’ refers to territory in France, but the Orange family was Dutch. They had a rather complicated and changing status as the first family of a country with no monarchy, tending to lead the army and to some degree provide a focus for central executive power in a  very decentralised system. The invitation to William enabled him to become King by will of parliament, but as he was the husband of the next in line to James, apart from his son, the hand over to William could be concealed as Mary taking her inheritance.

Myths of Sovereignty and British Isolation XIII, Revolution and the Dutch Model in the mid 17th Century

The last post went up to the reign of James I in the early seventeenth century known as Jacobean England/Britain, because Jacobus is the Latin form of James. James I was also James VI of Scotland, unifying the two crowns in his person. He wished to created a unified British state, but this was not achieved until the early eighteenth century and Scotland always remained a distinct nation within Britain, de jure through different laws and state institutions, de facto through a distinct culture, or cultures, and a partly separate economy.

Sovereigntists and Eurosceptics might find the reign of James I to be an amenable part of history, with some qualifications. James I was married to a Danish princess and his son-in-law was a German prince at the centre of the opening phase of the Thirty Years War, a German and central European conflict which drew in the major European powers. James nevertheless kept British involvement very limited, though that would undermine any idea of Britain as distinct and exceptional as a champion of Protestantism in Europe. James could have played that role but preferred not too and was happy to try to ally with the major Catholic power, at least at the beginning of the Thirty Years War, Spain, though was also willing to give some support to French Protestants who had communities to some degree autonomous from the French state, which was a more generous attitude to religious ‘heresy’ than was shown in Britain.

Enthusiasts for the supposedly special and exceptional history of the English then British parliament will not find comfort in his notorious and eloquent belief in absolutism and divine right of kings, though James was sufficiently pragmatic and politically talented to realise that he could not avoid working with parliament in practice, at least in matters of new legislation and raising taxes. It can be said that his era is one in which Britain was not extremely involved in European affairs, colonisation of north America progressed, and parliament survived as a major state institution if not with the enthusiastic approval of James. That is the case for the twenty two year period from 1603 to 1625.

His son Charles, decent and cultured as an individual, was less talented at preserving the state and engaged in various forms of disruption. He tried to rule without parliament by stretching his tax powers to a creative extreme and pushed through changes in the doctrine and ritual of the Church of England with some brutality. This all started becoming counter-productive when the Scots rose up against a clumsy attempt to enforce conformity to the changed Church of England, though differences in the Scottish church had been recognised under James. The very brief summary of subsequent events is that Charles lost the subsequent Civil War/War of the Three Kingdoms, and lost his head after failing to acquiesce in a more limited form of monarchy.

A strong strand of sovereigntist-Eurosceptic thought comes out of a Tory detestation of the execution of a king and the institution of a republic known as the Commonwealth. Such blunt dislike of a movement which at least started as an increase in parliamentary power looks a bit odd now after a long period of purely symbolic monarchy in Britain and Oliver Cromwell who betrayed or stablished the republic as Lord Protector after three years, has long been recognised as a constructive and personally honest figure in British state history, even by those with a strong dislike of his more autocratic and religiously enthusiastic inclinations.

Some republicans, such as the poet and political thinker John Milton were themselves inclined towards a very Anglocentric understanding of liberty and Protestant religion (the Civil War was in significant part about the rights of those Protestants not conforming to the Church of England), so providing a kind of alternative sovereigntist narrative to the royalist story. In the past the republican narrative has been associated with the left, but the Eurosceptic right has to some degree recently been happy to be associated with it, as they attempt to associate the European Union with seventeenth century absolute monarchs supposedly following a state system foreign to the ancient Liberties and Constitution of England.

One problem with this is that republicans were initially eager to pursue a state union with the Dutch Republic which provide a model of republicanism in Protestant Europe. This failed because of a Dutch wish to protect a privileged trading and colonial system from British competition, and avoid being swallowed up by a bigger state. The Dutch Republic of the United Provinces was not even the only European model of republicanism. The most important British republican of that time, James Harrington, was inspired by Machiavelli and therefore the Florentine republican tradition, though he did not follow Machiavelli in every respect.

It should also be noted that European assemblies sometimes had more power than the English parliament. Though Spain of that era is generally associated with absolute monarchy of a cruel and even obscurantist type, the reality is that provincial assemblies and laws strongly hemmed in the power and tax raising capacities of the Habsburg monarchs, to the extent that these autocrats were less able to raise taxes than English monarchs and finance an effective state system.

Myths of Sovereignty and British Isolation XII, 16th Century England in relation to the Dutch Revolt, Germany & Spain

The idea of a very sovereign and separate England, which does not really fit with the highly French oriented Middle Ages as discussed in the last post, may look a bit more plausible after 1485 when the Tudor dynasty came to power, ending the Wars of the Roses between different Plantagenet claimants to the throne. Under the Tudors, the English (including Welsh) state system is consolidated, the English church passes from authority of the Pope in Rome to the monarchy, and the dynasty ends in the unification of England and Scotland. That is when Elizabeth I died in 1603, the throne passed to the Stuart King of Scotland, James VI, who became James I of England.

The break with the church in Rome was an accident which had nothing to do with the religious inclinations of Henry VIII, who took the national church under his control for marital reasons. In the mid-1520s, he wanted an annulment of his marriage to Catherine of Aragon, in which the Pope would declare the marriage to have been invalid according to Canon law (in this case  because she had been married to Henry VIII’s late brother) . The Pope would have been willing to co-operate, but was under the control of Catherine’s uncle Charles V (German ‘Holy Roman’ Emperor and King of Spain), who regarded the proposed annulment as an insupportable insult to the imperial-royal family honour.

Conveniently for Henry, it was a good time for finding a religious base for a national church independent of Rome. The Reformation, that is revolution of new Protestant churches agains the Catholic church was underway, in a process normally dated back to Martin Luther posting 95 theses critical of the hierarchy on a church door in Wittenburg in 1517. Henry VIII did not break with Rome because of Protestant inclination and though there was a dissident religious tradition, the Lollards going back to the  fourteenth century, which anticipated Protestant thinking, it was a movement of strictly minority interest. Henry seized church lands and allied himself with Protestants. This accidental partial adoption of Protestantism was followed by swing towards more pure Protestantism under Edward VI then a swing back towards Catholicism under Mary Tudor followed by a final victory of Protestantism under Elizabeth I, though not a victory of the most radical Protestants, and not a result of majority sentiment in the nation, which would have favoured Catholicism before decades of state pressure and persecution made Protestantism the majority religion.

The struggle of the Protestant cause in England was associated with an intensified presence in Ireland through very bloody means, and an international struggle against Catholic Spain, associated with support for the Dutch Revolt against Spanish and Catholic control. Overall this might give the picture of England, as a proto-United kingdom fully incorporating Wales and partly incorporating Ireland, rising up as a free Protestant nation outside the control of the major trans-European institution of the time, the Catholic church. However, Protestantism was an import from Germany (Martin Luther) and Switzerland (John Calvin’s Geneva and Huldrych Zwingli), even if some tried to see it as the product of Lollardy.

The time of Elizabeth and the first Stuart James I was the time of colonialism in the Americas, which sovereigntist-Eurosceptic enthusiasts are inlined to see as part of Britain’s unique global role. This claim seems strange given the major colonial ventures of Portugal, Spain, and the Netherlands at this time. Britain was not uniquely Protestant or uniquely colonial and trading. The consolidation of a national state at that time has equivalents in Spain, Portugal, France, the Netherlands, Denmark and Russia. The ‘growth’ of Parliament under the Tudors absolute monarchs who conceded that taxes had to be raised by Act of Parliament, and that laws properly speaking were also from Acts of Parliament, but held onto complete control of government  and saw no need to.call Parliament except when new taxes or laws were needed, is paralleled by representative institutions in the new Dutch Republic, the continuation of German and Italian city republics along with self-governing Swiss cantons, the continuing role of regional assemblies in Spain and local courts ‘parlements’ in France which had the power to comment on new legislation, and the elective-representative structure of the Holy Roman Empire all provide parallels.

English state and national life was caught up in Europe most obviously through support for the Dutch, but also in the trade and diplomatic activities of the time. Mary Tudor, who attempted Catholic restoration, was married to Philip II of Spain while she was Queen, so placing England under heavy Spanish influence. Defeat of the Armada (Spanish invasion fleet) under Elizabeth became a symbol of English independence, but was itself strongly linked with English involvement in the Netherlands. So it was not a period of continuous English independence from European powers and was certainly not a period of isolated separation. The connections with the continent were reinforced during the reign of James I who had dynastic connections in Denmark and Germany.

Myths of Sovereignty and British Isolation, VI. From the 1832 Reform Act to World War One

In this post, a look at comparative growth of democracy in Europe along with Britain’s role in World War One and subsequent European diplomacy.

Britain made some progress towards extending voting rights beyond a very tiny minority in the Reform Act of 1832, which was also a law to make constituency distribution relate to the population of the time, particularly the expansion of the urban population, abolish constituencies of a few voters where the MP was in practice appointed by the local dominant landlord and even out a very inconsistent voting system, reducing the number of people who could vote in at least one case. The overall right to vote was extended from about 5 per cent to about 20 per cent of the population, which did mark a genuine shift of power from the aristocracy and put Britain in a good place in terms of comparative voting rights by the standards of the time. Nevertheless, there was working class disappointment expressed in the Chartist movement which mobilised mass support, but was ignored.

The next major change came in the 1867 Reform Act, which did not introduce universal male suffrage, but did extend voting rights to a significant part of the urban working class. Universal male suffrage at the age of twenty-one did not come until after World War One, alongside suffrage at thirty for women, followed a few years later by voting rights at twenty-one for all women as well as all men. Denmark and Switzerland introduced universal male suffrage with meaningful pluralistic elections in 1848. France reverted to the lost revolutionary republican idea of universal male suffrage, though the meaning of elections was highly constrained by the rise of Louis-Napoleon Bonaparte to the presidency, which he transformed into the role of Emperor. Prussia, while reserving a powers to the monarchy and preserving the power of the aristocracy through a weighting of the electoral system to the highest tax payers, did introduce universal male suffrage in 1849.

The 1867 Reform Act in Britain still left it behind these countries, particularly as France became a pluralist democracy after 1870 and a unified Germany appeared in the same year (the events are linked by the Franco-Prussian war of 1870) with universal suffrage, but the same weighting towards the upper class within the Kingdom of Prussia, the largest and most powerful part of the new German Empire, which had a distinct and dominant status within the Empire. As we can see, discussion of the comparative growth of the suffrage and political pluralism soon gets into very complicated details, which also include questions of how much power elected bodies had in relation to hereditary monarchs, so that is the end of the examples.

Anyway, the general pattern is that though Britain was ahead of just about all of Europe outside Switzerland in giving power to elected institutions, there is nothing special or exemplary about the spread of voting rights in Britain. In the nineteenth century it was certainly republics, just Switzerland then France, which established the best situations, which certainly challenges any idea of a special virtue in the British combination of monarchy and parliament. The exemplary monarchical state was Denmark rather than Britain.

Moving onto the First World War, as has already been shown, British entry was not a re-entry into European politics after a complete absence after the Battle of Waterloo. Britain was constantly engaged in European affairs and would not have entered the Great War, if it had not been concerned enough with European politics to establish alliances and have a strong view about German armies invading France and neutral Belgium.

Who to blame for World War One and the question of whether Britain should have taken part are rather divisive questions across political distinctions, so it is difficult to talk about a unified sovereigntist Eurosceptic narrative here, or indeed any political tendency, however defined, having a unified narrative. So it can at least be said that World War One does not add to any claim to the innate superiority of Britain and if Britain was right to intervene, that cannot make it more morally admirable than France and Belgium. The intervention right or wrong certainly reflected British views of its own interests in keeping northwestern Europe, the land mass facing it across the seas, out of the control of a hegemonic European power

It can at least be said that even for those who think on balance Britain was right to come to the full aid of France and Belgium, the continuation of the naval blockade of Germany, part the armistice which ended the war into 1919 was a horrifying policy of suffering imposed on an already defeated and impoverished German population, depriving Britain of any claim to rise morally above the other European powers.  In any case there is no denying that Britain was involved in European politics during the War and after in the Paris peace treaties, the revision of the Treaty of Sèvres, signed with the Ottoman Empire, in the Treaty of Lausanne signed with the Republic of Turkey in 1926.

Myths of Sovereignty and British Isolation, V: Britain and European Models

The last post looked at how Montesquieu’s The Spirit of the Laws, the biggest classic of Enlightenment political thought, certainly in size and probably in importance, does not offer Britain as the model of liberty for Europe. Rounding off that argument, Germany produced its own important liberty oriented thought at the end of the eighteenth century in the work of Immanuel Kant and Wilhelm von Humboldt, in which they do not offer Britain as a model. Of course at this time Britain stood as an example of liberty, particularly in the exact period from 1792 when the French Revolution had turned highly violent and dictatorial, and European monarchies were tending to become more conservative-authoritarian in reaction.

Nevertheless, the opening phase of the French Revolution developed a much more complete vision of a equal citizens under laws they had made themselves through representative citizens than Britain itself. France was the home of great liberal thinkers such as Benjamin Constant (like Rousseau and Voltaire, Swiss in origin) and Germaine de Stael, who were  horrified by the descent of the French Revolution into state terror and then Bonapartist dictatorship. Switzerland and the variety of German states within the loose structure of an empire (the Holy Roman Empire of the German Nation) gave them ideas for liberty.

Going back to Germany itself, there was a strong element of aesthetic liberalism, focused on the cultivation of individuality and individuality sensibility, which drew on the growth of German culture at that time and the history of many different states and state forms, that includes Johann Wolfgang von Goethe, Friedrich Schiller, and Friedrich Schlegel that had a European wide influence, including in Britain.

On the level of what was going in European nations during the eighteenth century is should be noted that the death penalty was abolished in the state of Tuscany in northern Italy in the late eighteenth century at a time when Britain was famous for widespread use of the death penalty, not just for murder and treason but for small crimes in property. The French Revolution inspired severe attacks on civil liberties in Britain and one of many rounds of state force to keep the Irish down, when the United Irishmen revolted in 1798 for Irish self-government.

Britain was largely ahead of the rest of Europe at the end of the wars with Revolutionary and Bonapartist France, but that was in large part because Britain had worked very hard to finance and encourage autocratic monarchies to take back control of Europe. Napoleon was no friend of liberty, though some British sovereigntist-Eurosceptics nevertheless celebrate him, as in Andrew Robert’s recent biography Napoleon the Great. Not for the first time a British sovereigntist shows signs of wishing to imitate European nations at times when they seem most aggressively sovereign, while holding to British separateness and superiority.

As the nineteenth century unfolded, Britain started as a nation where the existence of an elected parliament, a limited form of monarchy in the process of becoming a purely symbolic monarchy, and strong legal institutions allows a case for saying that Britain was leading the way in liberty, at least for those belonging to the most marginal and dominated parts of the state territory. However, that picture applies less and less after 1830, when the July Revolution put in place a system in France, under the Orléanist monarchy, comparable to that in Britain for promoting law, liberty, and commerce. It must be said that the preceding system introduced after the defeat of Napoleon under the restored Bourbon monarchy was directly modeled on Britain’s, but could not work like the British system, given the different national context. A lesson in the dangers of thinking that liberty can be exported and designed from abroad.

The 1848 cross-European ‘Springtime of the Peoples’ undermined the relative advantages of the British system further as republics and monarchies limited by constitutions were proclaimed in various parts of Europe. There was a big autocratic reaction reversing most but not all of this. Denmark made the most progress, with peaceful demonstrations leading to a constitutional monarchy and an elected national assembly. France reverted to autocracy under the Second Empire of Napoleon III (nephew of the famous Napoleon). However, the Second Empire did have elected bodies and however objectionable Louis-Napoleon’s seizure of sovereign power was, he was a moderate autocrat presiding over a continuing growth of civil and commercial society. If we look at models for liberty in Europe, Britain was certainly important, but so was France. Even under Napoleon III, France was a long way ahead of most of Europe in the liberties of its people and the vibrancy of the economy.

If we look at one of the most important events in nineteenth century Europe, the Risorgimento which turned Italy from multiplicity of more or less autocratic states, including the Austrian armies more of less resting on church domination of society and Austrian armies, into a unified nation; France was important in providing a model of a relatively secular liberal catholic society and in pushing for a more modernist liberal form of government in Italy. Napoleon III’s behaviour was opportunistic and designed to revive French power in Europe, but nevertheless he seems to have had a genuine sentimental attraction  to the idea of a free and unified Italy. Camillo Benso, Count of Cavour, as chief minister of Sardinia-Piedmont was the major political architect of a unified Italy was impressed by both the French and British models. The ideological architect of the Risorgimento, Giuseppe Mazzini, largely lived in London and was impressed by the British type of constitutionalism and political culture, but nevertheless was also a republican and European federalist more influenced at the level of political thought by the French revolutionary and republican heritage. The military architect of the Risorgimento, Giuseppe Garibaldi, was popular in Britain, but belonged to the French republican revolutionary heritage, which he worked to spread in South America before returning to Italy.

Myths of Sovereignty and British Isolation, IV: Britain the Enlightenment model for a liberal Europe?

Following on from last post in this series, focused on the violent formation of the nineteenth century British state, a largely political theory post on how far Britain had a special status as a model of liberalism and then democracy in Europe. Despite all the negative aspects discussed in the last post, there was of course some overall progress in Britain in creating a society and political system based on law, tolerance, individual rights, and a commercial society with prosperity spreading to all, sooner or later, though clearly much later for the afflicted groups discussed in the last post. Now it is certainly true that in the eighteenth and nineteenth centuries, and more recently, Britain has been taken as a positive example for those wishing to promote those good things in their own political community.

The trouble with the Eurosceptic-sovereignty view is that these realities are transformed into a belief in a British legal and state community uniquely, and its very essence, prone to liberty under law and all the associated benefits, and recognised such by all Europeans gracious enough to acknowledge British superiority. Let us look at the eighteenth century discussion which is when comparisons of Britain and European states around law, liberty, civil society and so really got started. Strange as it might seem to some, earlier thinkers about liberty like Machiavelli, Grotius, and Pufendorf did not promote the idea of Britain as exemplary. The eighteenth century French Enlightenment certainly did lead to some admiring interest in Britain from that point of view. Maybe the main populariser of Enlightenment, Voltaire, was a great Anglophile. However, the really intellectually important observer in France at that time was Charles-Louis de Secondat, Baron de Montesquieu, author of The Spirit of the Laws, who did visit England (but not the rest of Britain).

Montesquieu could be said to be something of an Anglophile and he has sometimes been taken as the bearer of a British model of liberty throughout Europe, as if he recognised Britain, as superior, of course to France. Though this is a familiar story in terms of the urban myths of history of political thought, it is not really plausible for the more sophisticated reader. Questions of interpretation of Montesquieu of course arise here, but there is proper interpretation of Montesquieu based on a thorough reading which could justify the view of him as possessing a political theory based on Anglophilia.

Montesquieu recognised two kinds of state compatible with liberty and ‘moderate government’, meaning government restrained by law along with a general respect for customs and moral standards. Those two types of government are monarchy and republic. Montesquieu also regarded a republic as less compatible with commercial spirit – which he strong endorsed – than monarchy, though he recognised exceptions and transitional cases. For Montesquieu, republicanism, at least in any pure form, meant some very small homogenous community with laws adopted by the people as a whole or an aristocracy. In both cases, Montesquieu thought that wealth tended to undermine the possibility of a republic, as such a state rests on putting ‘virtue’ (largely meaning patriotism and respect for law) above wealth in a very strong way. A monarchy, he thought, rested on ‘honour’ (largely meaning the search for status through wealth or through high position in the monarchical state). So a commercial society was more likely under monarchy than a republic. Montesquieu had in mind a large modern European state, which showed that to be case, France.

For Montesquieu, Britain was a disguised republic, a quite realistic assessment since political power rested with an aristocratic-oligarchic elite under a crown, which could not raise taxes or go to war without parliamentary approval. Montesquieu recognised that Britain was a great trading and commercial country, but at that time the same could be said for France which had a much larger population and therefore was a more important example of commercial society. Anyway, though Montesquieu had some complimentary things to say about Britain, he regarded it as culturally inferior to France, a view he expressed in his own way partly through complaining that there was less enjoyable social relations between men and women, a sign of backwardness.

Montesquieu was sceptical about the relevance of republics to the modern world except as city states, like Venice, or those German cities which were self-governing, or better for reasons of strength and survival, as federations of city states (or maybe rural communities of similar population), like the Netherlands of the time (known as the United Provinces) and Switzerland. Montesquieu looks at so many perspectives and considers so many examples that there is some difficulty in saying what his model was, but the evidence is for a choice of the French monarchy, emphasising how much power in reality rested in institutions other than the monarchy, such as law courts, town governments, universities, and the church. If he was not arguing for the primacy of the French model, he must have favoured the federated republics of his time. He has more to say in detail about Britain and it had good things about it, but there is no way in which Montesquieu had an Anglophile political theory which legitimates soveriegntist-Eurosceptic assumptions of special, separate, and superior status for Britain in relation to Europe.

Milton on Free Political Institutions: ‘The Tenure of Kings and Magistrates’ (1649), ‘A Treatise of Civil Power in Ecclesiastical Courts’ (1659), ‘The Ready and Easy way to Establish a Free commonwealth’ (1660)

Milton made important arguments for the kind of political institutions which would serve liberty, as well as discussing to goal of freedom in discussion of opinion. Though there are two basic Milton texts identified here, I will not attempt to distinguish them here, let alone take into consideration every possibly relevant text by Milton. This is a period of rapid change in political institutions in England (also applying but unevenly and differently in Ireland and Scotland; at this time Wales has to be considered part of England), of experimentation including the execution of King Charles I just before the publication of the first essay identified was published and the institution of a Commonwealth and Free State, in that year, and of reaction in the sense of royal Restoration in the year that the last essay identified was published. Context matters and so does change, but I think for the purposes of this post as opposed to a blog about the details of Milton’s life as a man of letters and politics, this will be mostly an overview rather than a tracking of Milton’s evolution.

As with his views on free speech, Milton’s views on political institutions mix religious commitments with knowledge of English history and great scholarship of ancient texts. The knowledge of ancient texts to some degree overlaps with the knowledge of religious texts, which is one reason why intensified study of the Bible in the sixteenth and seventeenth century tended to serve general cultural development and liberty.

Milton’s objections to monarchy are partly established through his reading of the Old Testament/Hebrew Bible where he argues that God warned the ancient Jews against adopting the institution of monarchy. Anyone interested in following up which parts of Hebrew scripture Milton is using here should start with the First Book of Samuel, Chapter 8. Disasters that befall the Biblical Jews are in some measure the consequence of ignoring God’s counsel in this matter. Of course, many have seen the Bible as justifying not just monarchy, but absolute monarchy so Milton goes to some effort to argue that monarchy was a second best institution for the Jews from God’s point of view and that the Jews never gave their monarchs absolute power.

The view that Milton has then, of the rights and powers of kings, is that they are established by covenant with the community and not a divine authority which the community must obey. The idea of covenant is important in Christianity, with regard to the view that the ancient Jews had a covenant with God as his chosen people and that Christ offered a new covenant for all humans willing to follow him as the son of God. These covenants were very much emphasised in the Protestant culture of the sixteenth and seventeenth centuries, which thought it was returning to a relation with God obscured by centuries of Catholic interposition of church hierarchy between believer and divine word.

The idea of covenant moved quite quickly from theology to political and legal thought in Hugo Grotius (1583-1645), a Dutch theologian and legal-political thinker who was one of the major shapers of modern thought in these matters. Milton does not emphasise him in these essays, but he was certainly an influence. For Grotius, the covenant is at the centre of theology, and influences his view of the obligation to obey law and government, though he does not use the language of covenant greatly in that context. The point being in political terms that in some way laws and political institutions rest on some choice of the community to obey them. In Grotius’s thinking, this is more about the reason for obedience than an incitement to rebellion where laws and institutions lack popular backing, but the latter aspect is necessary outcome. This ambiguity carries on into the Leviathan of Thomas Hobbes (1551) which takes a foundational social covenant (defined more in legalistic than theological terms) as the basis of absolute obedience to the sovereign, but certainly influences the view of John Locke’s Essay Concerning Civil Government (1690) according to which ‘the people’ (in practice Locke meant the upper classes reğresented in Parliament) the right to overthrow government.

So Milton precedes Locke’s view that rebellion against unjust government is lawful, even admirable, and that laws are uniquely made by ‘the people’ in Parliament and never by a monarch. Milton himself draws on earlier historical precedent for this view of government as based on contract and the right of rebellion against government which ignores that contract. Particularly important is the Dutch Revolt of the late Sixteenth Century, in which merchant towns rebelled for political, commercial, and religious reasons against the absolutist Catholic monarchy of Spain which had acquired them for rather accidental dynastic reasons in recent history. Final agreement with Spain took a long time, but the new Dutch Republic quickly established the possibility of a mercantile republic in modern Protestant Europe and offered support to those who considered republics to be more Protestant than monarchies. Milton draws further on recent Scottish history, pointing out that a Protestant Scottish parliament had deposed Mary, Queen of Scots, in the preceding century. In general, Milton argues that the idea of monarch contradicts the idea of an ordinary human with an ordinary body, with legal accountability like anyone else, and so can never be incorporated properly into a state of free citizens.

Though monarchy which obeys such agreements is allowable from Milton’s point, it is not ideal and is very likely to decay into outright tyranny. Nevertheless he offers examples of how great monarchs of European history, including Roman Emperors, accepted that their power was only justified by serving law and the good of the community. As Milton emphases the last great Roman Emperor Justinian (ruling from Constantinople towards the end of the period during which any Roman Emperor controlled much territory beyond Anatolia and the Balkans) produced the greatest codification of Roman law, making himself the servant of law, not god on Earth. In any case is monarchy might be just about tolerable in many societies for Milton, the proper practice of Protestant Christianity certainly required a freedom from the religious and institutional church authority demanded by kings. Protestant ideas of free discussion of religious ideas and self-governing groups of believers could not thrive under a king (which was a reasonable estimate since Protestant Dissenters were not really equal citizens until the nineteenth century when the monarchy had become largely ceremonial, and indeed the last monarch who really struggled for a more than figurehead role, George III, was en enemy of religious emancipation).

Milton developed a view of how a republic, or commonwealth, might survive over the long term, certainly a longer term than the period it lasted in England, in its purest form only from 1649-52, and then the Lord Protectorship of Oliver Cromwell until 1658 and his heir Richard Cromwell until 1660. He thought that while the country might need a new parliament in 1660, once elected it should serve permanently, replacing dead or absent members through its own method. What Milton seems to advocate here though is not a permanent republican law, but something necessary to institute a permanent republic. Milton thinks of the beginnings of  a republic as embattled and as needing to act more like an army than a fully stabilised and secure civil republic should. Both the chance for election and eligibility to vote can be restricted while the republic secures itself against selfish internal a faction and external danger. Here Milton runs into the problem Niccoló Machiavelli, an ardent republican despite frequent misrepresentations, encountered in The Prince, how to get a people that is not very republican and maybe not very ready for a republic to the point where civic virtue and understanding of public good are strong enough for a workable republic.

Milton’s life and public service under the take over of the English republic by the quasi-monarch Oliver Cromwell, followed by his life and exile from public life under the restored monarchy, is the context for the quotation from Coleridge at the head of this post. For Milton, republicanism and associated ideals, became more and more associated with some better and other world. After the Restoration Milton certainly became the author of poetry rather than political essays, producing in particular Paradise Lost, a religious epic which places him just below Shakespeare in general evaluation of English literature. We could look there for a more ‘transcendental’ exploration of republicanism and liberty, and I had hoped to do so. However, this task will be deferred as I think a responsible investigation of republicanism in Milton’s poetry, though a recognised area of discussion, is just too big and different to incorporate into this sequence of posts. Later I hope.

Milton on Freedom of Printing: Areopagitica

A Speech of Mr John Milton for the Liberty of Unlicensed Printing to the Parliament of England (1644).

‘We turn for a short time from the topics of the day, to commemorate, in all love and reverence, the genius and virtues of John Milton, the poet, the statesman, the philosopher, the glory of English literature, the champion and martyr of English liberty’, Thomas Babington Macaulay (Whig-Liberal historian, writer and government minister), 1825.

The strange sounding title is a reference to one of the key institutions of ancient republican and democratic Athens, the court of Areopagus. Appropriately, as we are looking at an essay on politics by a great poet, the Areopagus and its mythical foundation was celebrated as the core of Athenian justice in Aeschylus’ tragic trilogy, the Oresteia. The Areopagus was itself an aristocratic institution preceding democracy in Athens and as such can be seen as what balanced the changeable majorities of the citizens’ assembly with enduring standards of justice, which have meaning in all ways of constituting political institutions.

What Milton looks for in this great institution of early experiments in constituting liberty is a standard for freedom of publication and finds that it offered a very tolerant standard, at least in the context of the seventeenth century. Milton suggests that the only restrictions the Areopagus placed on books of the time (all handwritten manuscripts of course) was with regard to atheism and libel. We are not going to look back at Milton or the Areopagus now as the most advanced instances of liberty when they prohibit expressions of atheism, but these are times when the idea that a good and rational person could not be an atheist were all pervasive and the assumption can still be found later in the seventeenth century in John Locke, one of the general heroes of modern thinking about liberty.

The restraint on libel applies in all societies and all political thinking I am aware of, but one should never discount the possibility of an interesting exception. Leaving aside possible interesting radical alternatives, there is nothing repressive by the standards of general thinking about liberty in restraining libel. Milton’s interest in the standards of pagan Greece is itself a tribute to a spirit of pluralism and open mindedness in someone generally inclined to take moral and political guidance from the religious traditions of Hebrew Scripture and the Gospels, along with the writings of early Christians, and the Protestant thinkers of the sixteenth century Reformation.

The Reformation, as Milton himself emphasises, relied on the printed word, and it is no coincidence that Protestantism emerged soon after Europe discovered printing (after the Chinese of course), as a weapon against the institutional authority of the Catholic Church and its hierarchy. The structure of the Catholic Church was not just a matter of church offering a choice to people seeking a faith-based life, it was connected with state power and pushed onto societies as the only allowable life philosophy. The politics of religion comes up in Milton’s essay, including the issue of the relation of the state to the church hierarchy.

While England had a Protestant Reformation in the sixteenth century (England including Wales, but excluding Scotland which had its own distinct Reformation before union with England), it had retained a state church, the Church of England, with Bishops. Milton, like many on the side of Parliament in the Civil War, was against Bishops, referred to as prelates, as part of the old Catholic hierarchy in which the ‘truth’ was given from above to the mass of believers.

Inspired by the pamphlets of and books of Protestant reformers, Milton argues that truth can have many forms and that while Christianity may require acceptance of central truths, they can be expressed in more ways than the Catholic hierarchical state-backed tradition allows. State backing, of course, included the imprisonment, torture, and burning to death of ‘heretics’ by the Inquisition.

Milton refers to the last pagan Roman Emperor, Julian ‘the Apostate’ (reigned 361-363) with regard to his policy of banning Christians from pagan education. Milton argues that this was the biggest possible blow to Christianity, because it deprived believers of the intellectual capacity and credibility to influence pagan inhabitants of the Empire. Christian truth could only be convincingly understood, communicated, and taught if it drew on all areas of learning including what had been produced by pagans.

Truth benefits from being tested in argument and contestation, something undermined by state-enforced church power as well as by the monarchical institution of courts full of sycophants and yes-sayers. Political liberty requires republican representative institutions and truth, including the truths of religion, require testing in conditions of liberty.

Unfortunately, Milton supported legal discrimination against Catholics, but as with prohibitions on expressions of atheism, this was part of the general understanding of a just state at the time, and Milton was more tolerant than many on the Protestant as well as Catholic sides. His arguments make up a part of the general movement to tolerance and freedom of speech, making very powerful points on behalf of liberty, enabling us to take them beyond the limits within which he constrained them.

Introducing John Milton: Republican and Poet (1608-1674)

John Milton is one of the major figures in the history of English literature. His poetry, particularly but certainly not only his epic Paradise Lost, has conditioned all of English literature since his own time. He was also a major political writer and advocate of liberty.

In some ways his appeal has become a bit more limited with the decline of religion as a major part of life in Britain and other English speaking countries, but he is still read and has influence on the non-religious no less than the religious. He came from a time when political and literary activity in England (strictly speaking there was no Britain or Great Britain in terms of the legal state until 1707, before which there was a union of three kingdoms or states, England, Scotland and Ireland with no superseding state on top) and across Europe was very tied up with religion. Both of the greatest English political philosophers of the seventeenth century, Thomas Hobbes and John Locke, were centrally concerned with the relation of the state to religion. The last thinker I discussed, James Harrington, though not very religious in orientation, still discusses the Biblical ancient Jews in his political writing.

Milton was a Puritan in religion and a republican in politics. To say he was a Puritan is to say he was one of the more radical Protestants outside of the mainstream of the state church as it existed under English kings. Puritan was originally a pejorative label associating religious dissenters and radicals with joyless fanaticism. This might have been an accurate description of some Puritans, but not all and certainly not Milton. He travelled in Catholic Europe where he made friends and intellectual interlocutors. He advocated for the right to divorce, which had been no more recognised in Protestant England after the Protestant Reformation of the sixteenth century than in preceding Catholic England. His learning, including that of ancient pagan classics, was greater than normal for bigoted fanatics. Furthermore, his poetry shows great joy in the pleasure of words and imagination, traits uncharacteristic of the bigot whose greatest pleasure is to think of his enemy burning in hellfire.

Even the more joyless kind of Puritan often showed a spirit of equality in social life, democracy in church government, and the value of all honest work, along with a belief in enough education for children to at least study the Bible carefully and intelligently, which played a large role in the growth of liberty, commercial society and civil institutions in England. This was not an era where complete religious tolerance, or complete independence of the individual from the state, was at all mainstream and even the most tolerant states (the Netherlands being the best candidate) did not have complete equality between faiths or tolerance for open non-believers.  For the time, Milton was at the more tolerant end of the spectrum and so were many other Puritans, despite the forbidding associations of that term.

Milton lived through through the Civil War (1642-1651) between Crown and Parliament and was a strong supporter of Parliament as were Puritans in general, though Milton’s political views should also be seen in the light of his classical learning and respect for the republics of ancient Greece and Rome.

Parliament’s victory lead to the creation of an English republic known as the Commonwealth in 1649, and Milton’s advocacy of republicanism led to an appointment as Secretary of Foreign Tongues, an office which required him to compose correspondence with foreign governments in Latin and continue a defence of republicanism for a European audience. Milton continued in this post as the Commonwealth gave way to the Lord Protectorship of Oliver Cromwell, the most outstanding general of the parliamentary army. This was not an explicit repudiation of republicanism, but did reflect the difficulties of organising parliamentary government in a country used to monarchical governments.

Parliaments were very happy to offer Cromwell powers he was not ready to accept, and even the explicit title of king. Cromwell essentially served as an uncrowned king, making various experiments with parliamentary and military administration. Cromwell is sometimes portrayed as a religious fanatic and tyrant, but he restrained the intolerance of the most radical Puritans and was not religiously intolerant by the standards of the era. His tendency towards more militaristic and personal government reflected institutional failures rather than a plan for absolute personal power. He purged and selected parliaments, but all previous parliaments had presumed the subservience of MPs to monarchical domination and conformity to the state church.

Cromwell’s darkest reputation arose in Ireland, but tales of Cromwellian massacres of Irish Catholic civilians are now agreed by Irish historians to be highly exaggerated. What he was guilty of was completion of a long process of subordinating Ireland to England, and of removing power and landed property from the Catholic majority. Deplorable as this was, it was no more than the standard statecraft of the time. Cromwell did not establish an arbitrary violent despotism in England. He largely operated within the law and reformed the administration of the nation in an efficient and enduring way. He did not acquire spectacular wealth or establish a court of ostentatious luxury. Though Oliver Cromwell’s son Richard inherited the Lord Protectorship, Cromwell had not prepared the way for the dynastic rule of his family, and power returned to the previous royal family.

I have discussed Cromwell’s status as a figure in English history to show how a sincere republican like Milton could continue in his state position. There is no reason to think he did so for reasons of acquiring wealth or addiction to power. He remained true to his principles after the return of the monarchy, unlike many, and was in real danger of very serious legal consequences. Fortunately those who respected him in the new regime, after abandoning the old regime, intervened and Milton was able to live out his life peacefully though in rather simple style for one of the greater writers of the time.

Milton’s writings, along with the failed republican experiment and the Cromwellian administrative reforms, established the conditions for a second concealed republican revolution, the Glorious Revolution of 1688, which under the pretence of restoring a traditional relation between monarchy and nation, in practice established a successful aristocratic-commercial republic under a monarch who could only act in co-operation with Parliament.

Harrington, Commonwealth of Oceana, and A System of Politics (Expanding the Liberty Canon): Second of Two Parts

Oceana is a long piece of ‘utopian’ political fiction writing, which does not really work as an exercise in literary fiction as far as I can see and barely keeps up the pretence. Oceana refers to a thinly disguised version of Britain and a lightly fictionalised account of its history, as a means for expounding Harrington’s thoughts about the best political system. A System of Politics is a more concise and economical account of Harrington’s thought than Oceana though its list form tells you something about Harrington’s limits as a writer.

Harrington is in a friendly dialogue with a major sixteenth century writer, the Florentine republican Niccoló Machiavelli and sometimes in the  earlier part of Oceana in a critical dialogue with a major English writer, Thomas Hobbes, from his own time. The idea that sometimes still circulates of a liberal England/Britain versus an absolutist continental Europe is rather challenged by this. One of the most influential advocates of liberty in British history was inspired by an Italian against an English writer. Though Harrington does refer favourably to Hobbes’ own mentor, Francis Bacon, philosopher, chief minister to the monarchy, jurist, and writer of utopian political fiction. Harrington does not mention the Hobbes-Bacon relation, and his his use of Bacon’s thought suggests a fascination with the kind of monarchism advocated by Bacon which mixes legalism with the application of scientific method to the prudential art of government. Harrington, it appears, wanted republicanism to incorporate such aspects, creating some distance from ancient republicanism in which law comes from tradition and wise individuals rather than the kind of centralised accumulation of new laws and a judicial apparatus to apply them which is what Bacon was dealing with and which also influenced Hobbes. Harrington’s interest in what well run monarchies with some respect for law can teach republics also expresses itself in remarks on the Ottoman Empire and on the famous chief minister of the French monarchy, Cardinal Richelieu, one of the key figures in the development of the modern state and modern statecraft. Harrington regrets lack of knowledge of the principles underlying Richelieu’s formidable achievements in promoting peace within France and taking France above Spain as the leading European power of the time.

When Harrington is focused on republics strictly speaking, he has two main concerns: land distribution, formation of the right kind of aristocracy. These concerns overlap as questions of concentration of land are also questions of what kind of aristocracy might exist. Harrington resists what he regards as the too extreme devotion of the Ancient Athenians to democracy, which did not allow an effective aristocracy to form. As with early modern attitudes to Plato, his preference for Sparta is rather against modern sensibility. However, that preference ran up to the American Revolution and the Constitution of the United States which was deliberately designed to prevent the ‘excesses’ of Athenian democracy and promote a ‘balanced’ republic like those of Rome or Sparta which had a long life based on reserving some powers for the aristocratic parts of the political system.

Harrington’s thoughts about aristocracy are directed towards forming a changing open class of people who provide political leadership and resist the wilder extremes and instability of popular opinion. This is more or less a project for the formation of an effective version of what is now generally referred to as a political class or a political elite. Harrington’s belief that the aristocracy should change in composition and exist in balance with the preferences of the common people lead him to oppose land distribution of a kind which created a rigid permanent oligarchy aristocracy of the richest landowners. Laws to prevent this are referred to by Harrington as ‘the agrarian’, with consideration of examples from antiquity and from his own time. He argues against primogeniture (land going to the eldest son) and in favour of equal division of land between the children of landowners which he suggests as well as having political benefits will reduce loveless marriages designed to get propertyless daughters of the aristocracy married to a major landowner. In a rather more general way, he seems sympathetic to schemes to prevent concentrations of landed property. Such apparent interference with property rights may look at odds with how ideas of liberty develop in the classical liberal and libertarian tradition, but Harrington was living at a time when it was very difficult to disassociate land ownership and political power, and more generally difficult to disassociate economic status and political rights.

It takes the continuous  greater development of commercial society which Locke reacts to at the end of the seventeenth century to see that property ownership should be seen in terms of transferable rights and the public benefits of land owned by whoever being part of a commercial system in which its products are traded to everyone’s benefit. The other side of Harrington’s assumption, highly normal for the time, that political power comes from land ownership, is that servants and the economically dependent cannot have full political rights and are not part of the democratic political system. The democratic system that elects an open changing aristocracy in some form of senate along with a a very complex series of other elections of public officials advocated by Harrington. This was enough to make Harrington seem like a fanatic for extreme democracy until democracy did begin to appear in the British political system, with the extension of the franchise in the late nineteenth century following on (but not immediately at all) from earlier agitation on the part of the new industrial working class. His writing is bit frustrating and can seem a bit remote from current ideas of liberty, but in historical context he made a major contribution to the growth of law and liberty in Britain. He deserves to be read by anyone who wishes for a really deep understanding of the development of ideas of government constrained by law and liberty.

James Harrington (1611-1677) was synonymous with the idea of democracy in Britain for centuries, but is not much read now beyond the ranks of those with strong interest in seventeenth century British history or the history of republican thought. Republicanism was the word used for thought about a political system under law and in which power is shared, with some protection of individual liberty, until the word liberal started being used in the eighteen century, with more emphasis though on the idea of liberty of trade and commerce. The republican tradition certainly stretches back to Aristotle in ancient Greece and can be taken back to his teacher Plato, though that often troubles modern readers for whom Plato seems disturbingly indifferent to individual rights and hostile to change. That will be a topic for another post, but for now it is enough to say that Aristotle is likely to seem relevant to ideas of individual liberty for the contemporary reader in ways that Plato may not and Aristotle’s own criticisms of his teacher are likely to seem appropriate to such a reader.

Harrington’s texts are not an easy read in that their structure is not clear and he does not have much in the way of literary style. This explains to a large degree why he is not a familiar name now along perhaps with the appearance of more recent writers in English concerned with liberty and democracy who are both more readable and more concerned with liberal democracy as it has developed since the late eighteenth century, particularly John Stuart Mill. In comparison Harrington seems stuck in early modern idea of democracy and republicanism which are expressed through a knowledge of texts which though not forgotten now are less obviously known to the educated reader. That is the texts of the ancient Greeks and Romans and the Bible. The educated in Harrington’s time were likely to read Latin and often read Greek as well, with major classical texts forming a common frame of reference. The Bible was widely known in the seventeenth century because Christianity was a very dominant force, and Harrington was writing at a time when the Protestant Reformation which led to the translation of the Bible into modern languages and encouragement to the faithful to read the Bible carefully and frequent was still a very living force. Catholics of course read the Bible, but the Catholic authorities resisted translating the Bible into modern languages before the Reformation and gave comparatively less importance to the individual study of it than the Protestant churches. So in short, Harrington’s writing comes from a  time of intimate and shared knowledge of ancient and religious texts, and his way of writing is not too suited to expressing itself to those not acquainted with that culture.

In addition Harrington, assumes some familiarity with the British and European politics of his time, though much of it is of lasting interest with regard to understanding of the formation of modern European states and ideas about the most just form of politics for those states. Venice is a very important example of a republic for Harrington, reflecting its status as the longest lived and most powerful republic known to Europeans at that time. The formation of the Dutch Republic in the late sixteenth century promoted a possibly stronger republic, but Harrington regards it as a loose assembly of city and regional republics, so still leaving Venice as the most powerful republic with a  unified sovereignty. Italy was not united politically at that time and Venice had existed since the eight century as an aristocratic republic in which aristocratic government combined with merchant wealth to an extent that made Venice a leading trading and naval power in the eastern Mediterranean. The Ottoman Empire appears fleetingly as the model of monarchy, an image which dissipated in the eighteenth century when the Ottomans began to seem backward and despotic, and to be at the head of a declining power. The power and the sophistication of the Ottoman state applying a system of laws and justice across a large and diverse territory made a rather different impression in a seventeenth century Europe suffering from religious wars and internal conflict even within powerful states.

Harrington himself lived through the English Civil War (1642-1651), also known as the The English Civil Wars (because it was a series of wars), the Wars of the Three Kingdoms (because it comprised separate conflicts in England, Scotland, and Ireland), and the English Revolution (because it resulted in the execution of King Charles I along with a period of constitutional innovation in the commonwealth and lord protector systems), which included religious conflict between different forms of Protestantism and political conflict between crown and parliament. Harrington was himself part of the section of the gentry supporting parliament against the king, though he also appears to have had friendly relations with Charles I while he was detained by parliamentary forces.

Oceana was originally banned while being printed during the Lord Protector phase in which the head of the parliamentary armies, Oliver Cromwell had become something close to a king. The book was legally published after negotiations between the Lord Protector’s government and Harrington’s family, with a dedication to Cromwell. Harrington was however accused of treason after the restoration of the monarch and though he was released after a short period of punishment never recovered in mind or body. So Harrington’s life and publication history is itself marked with the historical traumas of the time and the failure to establish enduring republican institutions.

Why Republican Libertarianism? V Concluding Remarks

(This text was written for the European Students for Liberty Regional Conference in Istanbul at Boğaziçi University. I did not deliver the paper, but used it to gather thoughts which I then presented in an improvised speech. As it was quite a long text, I am breaking it up for the purposes of blog presentation)

There is a tendency within liberty oriented though which sees the intrusions of the state in the modern world as something to do with republicanism and the democratic political spirit. The development of what has been called the administrative state, administered society, the iron cage of bureaucracy, disciplinarity (generalised power throughout society), biopower (sovereignty over life and health), and so on, has taken place in all state forms. It is deeply embedded in the emergence of modern industrial world, where traditional authority structures and customary laws are eroded by city life, national and international markets and technological innovation.

This process has one aspect the emergence of a modern state in which we see national debt financing an investor class, and the expanded central state enforcing uniform legal codes. There is a political economy of this which ties interest groups to the state, and tries to find ways in which everyone could be defined as belonging to a group that benefits from state action. At any time we see states in the double process of maintaining such a political economy and using state power to protect the associated institutions.

There are periods in which such developments of the state take place at a heightened pace, usually due to war of some kind and maybe a collapse of attempts at peaceful balance between groups in a society. Groups  which seem marginal or even as the source of violent resistance are assimilated or subject to maximum state force.  in practice has always gone along with these developments, in all forms of state.

A lot of this has come out of the pre-modern monarchical state reinforcing its traditional power. Resisting he administrative-bureaucratic state means engaging in politics, in citizen movements, in peaceful civil disobedience where necessary to defend basic rights. That is not  looking back to pre-modern forms of law, authority and statehood, in which pluralism exists in rigid state enforced hierarchies, and tradition limits individual self-creation. In the modern world republicanism has sometimes acquired a ‘Jacobin’ form of intense and violent state creation, but as Tocqueville pointed out in The French Revolution and the Old Regime, it carries on the work of the old monarchy in doing so.

The republican political tradition has to some degree acquired a tainted reputation due to association with the most violent aspects of the French Revolution, and Machiavelli’s frankness about what can happen when regimes change. However, the violence attributed to the republican moment was always at work before in the strengthening of central political institutions and the unified ordering of the society concerned. There have been such moments throughout history, but the shift to the modern administrative state has made them  much more thoroughgoing in  their influence on social relations.

Republicanism is a way of coping with this that tries to bring in the restraints of law and accountability to the public in various forms. It has not been an escape from the modern administrative state, or the violence accompanying much of the historical emergence of that state, but no other way of doing politics has escaped either, and the republican way even in its worse moments has at least emphasised the principles of law above persons, the non-passive rights of citizens, and the importance of instruments of political accountability. The monarchist and depoliticised forms of thinking about liberty have also sometimes collapsed into state terror, without the message that a better way exists. The conservative empire and the traditionalist state have used, maintained, and intensified violence in reaction to real and perceived threats without being able to offer the prospect of better political forms and structures than the hierarchies of tradition. The differences are not absolute, as Tocqueville indicates, and at times republican city governments have existed within traditional hereditary states, and monarchist reformers have attempted to bring in ideas with republican origins. A republic can collapse into a permanent system of personalised authority, but it is the republican tradition which tells us what is wrong with that.

In any case, republicanism as it exists now in political thought is concerned with restraints on power not intensification of state power. Its engagement with historical situation and concrete politics, its appeal (at least in the form associated with Hannah Arendt) to individuality and contestation in politics is the best way of making a complete application of the principle of liberty to the political and historical world.
